These Terms of Use (“Terms”) govern access to and use of the messaging, voice, and communication services (“Services”) provided by JoinIndia Technological Solutions Limited, operating under the brand OnlineSMS.

By registering, accessing, or using the Services, you agree to comply with applicable laws, including regulations issued by the Government of India, DoT, TRAI, and Telecom Service Providers.

Effective Date: 10 March 2005 (as amended)

1. Scope of Services

  • SMS (Promotional, Transactional, Service Implicit)
  • Voice Calls (Outbound / Inbound / IVR)
  • WhatsApp Business Messaging
  • RCS Messaging
  • Email & API-based messaging integrations

All services are provided strictly as Application-to-Person (A2P) services and are subject to regulatory and operator approvals.

2. Regulatory Compliance & DLT Obligations

You acknowledge that all messaging in India is governed by TCCCPR and DLT regulations.

  • DLT registration as Principal Entity
  • Sender ID and template approvals
  • Consent acquisition and maintenance

OnlineSMS acts solely as a technology provider and assumes no liability for user data or consent compliance.

3. User Registration

  • Accurate and complete registration details are mandatory
  • You are responsible for login credential security
  • System logs may be maintained for audit and compliance

4. Consent & Opt-In Responsibility

You confirm valid, explicit consent from all recipients. Unsolicited or deceptive communication is strictly prohibited.

5. Acceptable Use Policy

You shall not use the Services for:

  • Spam, phishing, fraud, or spoofing
  • Illegal, obscene, misleading, or abusive content
  • Gambling, betting, adult content
  • Malware, viruses, or system abuse
  • Circumventing DLT or operator filters

6. Message Delivery

Delivery depends on telecom operators, network conditions, handset availability, and regulatory filtering. Delivery reports are indicative only.

7. Billing, Credits & Refunds

  • All services are prepaid unless agreed otherwise
  • Credits once deducted are non-refundable
  • Credits may expire or lapse due to inactivity

8. Suspension & Termination

OnlineSMS may suspend or terminate services without notice in cases of regulatory violations, abuse, or operator directives.

9. Limitation of Liability

Services are provided “AS IS”. OnlineSMS is not liable for delivery failures, revenue loss, or regulatory actions. Liability, if any, is limited to payments made in the preceding 3 months.

10. Indemnity

You agree to indemnify OnlineSMS against claims arising from content misuse, consent violations, or regulatory non-compliance.

11. Data Privacy

OnlineSMS follows reasonable security practices. You remain the data controller; OnlineSMS acts as a data processor.

12. Modification of Terms

Terms may be updated due to legal or regulatory changes. Continued use constitutes acceptance.

13. Governing Law & Jurisdiction

Governed by the laws of India. Courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction.
